Terms and Conditions
Purchasing products from the NU Wines Online Store is subject to the following terms and conditions:
1. Object
1.1 These General Conditions in effect, together with the order form and other elements referred to herein, regulate the terms and conditions governing the provision of the Service in the NU Wines Online Store.
1.2 Purchasing any product from the NU Wines Online Store implies acceptance of these General Online Sales Conditions.
1.3 Access to the NU Wines Online Store is free of charge and does not require prior subscription or user registration.
1.4 Alcoholic beverages available for sale in the NU Wines Online Store may only be purchased by individuals who are of legal age to do so in their country of residence.
2. Product Information, Prices, and Content
2.1 NU Wines reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding products, prices, promotions, commercial conditions, and services.
2.2 Images illustrating each product on NU Wines may differ from the product eventually delivered.
2.3 Items for sale in the online store are subject to existing stock, and orders will be processed in order of arrival. In case of temporary or permanent stock depletion, the customer will be duly informed and offered an alternative with similar characteristics.
2.4 Under Portuguese law, product prices are indicated in € (euros) and include VAT at the legal rate in force, as well as packaging costs. Shipping costs to the customer are not included.
3. Ordering and Payment
3.1 To make a purchase in the NU Wines Online Store, the user should ideally register as a customer.
After registering, the user can place their order by selecting the desired products and following all described steps to complete the order successfully.
3.2 After confirming the order in the NU Wines online store, the user must select the preferred payment method from the available options, such as Multibanco, Visa, Mastercard, Paypal, among others. Any order placed in the NU Wines online store will only be processed after the effective receipt of payment. Formalizing the order alone does not constitute a reservation of products.
3.3 After confirming the order in the NU Wines online store, an email will be sent to the contact address registered by the customer at the time of order formalization, with all details about delivery, billing, and payment information. If the customer does not receive the order confirmation email, they are requested to contact NU Wines via telephone at +351924046109 or email at info@nuwines.eu.
3.4 Changes to or cancellations of unshipped orders can be made by requesting them via email at info@nuwines.eu.
3.5 Orders placed by users from countries outside the European Union must be previously validated.
3.6 Orders will only be shipped after stock confirmation and payment receipt, processed in order of arrival.
3.7 If an order cannot be fulfilled in part or in whole, the customer will be immediately contacted by NU Wines.
3.8 After receiving the order details, the user has 3 business days to make the payment. If not completed within this period, the order will be automatically canceled.
3.9 NU Wines Online Store offers the user the option of payment via bank transfer upon request via email to info@nuwines.eu.
3.10 Proof of bank transfer must be sent to info@nuwines.eu.
3.11 Payments are received in euros, regardless of the currency used for the transaction. Conversion fees for payments made in other currencies must be borne by the customer.
4. Shipping Fees
4.1 Shipping fees are calculated based on the product weight, destination, and total order value.
4.2 Shipping fees are indicated in the shopping cart before final order validation for deliveries within mainland Portugal. For deliveries outside mainland Portugal, the total shipping cost is calculated after order confirmation by emailing info@nuwines.eu.
5. Delivery
5.1 Orders will only be shipped after stock confirmation and payment receipt as quickly as possible.
5.2 Orders will be delivered to the address provided by the customer, according to the delivery schedules of the transport company. Home delivery cannot be made to P.O. boxes. Deliveries outside mainland Portugal are possible if the address is within the transporter's delivery area.
5.3 As the transport service is contracted to a company, potential delivery delays cannot be resolved by NU Wines, making it impossible to guarantee exact delivery times in such cases.
5.4 If the customer cannot receive the order or pick it up at the indicated location for any reason, they are requested to contact the NU Wines Online Store immediately via email at info@nuwines.eu.
5.5 All products shipped by NU Wines must be checked upon delivery. If the customer finds the order damaged, they should return it immediately to the transport company, indicate the reason for the return on the delivery note, and inform NU Wines Online Store via email at info@nuwines.eu.
5.6 If, after delivery, the customer finds that any of the items is not in conformity, they are requested to contact NU Wines immediately via email at info@nuwines.eu, providing the order number or the document number that accompanied the order, attaching images of the packaging as received and of all items, so the situation can be resolved as quickly as possible.
6. Returns/Complaints
6.1 The NU Wines Online Store allows the return of products within 15 days from the delivery date.
6.2 To request an exchange or return, the customer is asked to contact NU Wines via email at info@nuwines.eu, providing the invoice number.
6.3 Returns of defective products and wrong shipments are the responsibility of NU Wines, including shipping and collection costs, if the customer communicates this situation within 15 days from the product receipt date. Once the merchandise is received at our facilities and the condition is validated, the value will be refunded.
6.4 NU Wines is not responsible for deficiencies resulting from incorrect use, negligence, and poor storage conditions by the customer.
7. Changes to Sales Conditions
These general online sales conditions may be changed without prior notice and should be consulted before placing any order.
8. Data Protection
The customer must expressly declare that they authorize the collection or update of their contact data for integration into NU Wines' files for customer management, commercial relations, and advertising purposes of products and services under Law No. 6/99, Law No. 41/2004, and Directive 2002/58/EC, through automated processing and profiling by all available communication channels, including electronic means.
Express consent must be made during registration in the online store, in the option indicated for this purpose.
The collected contact data will be kept for the period during which the processing purpose was consented or until the right to object, rectify, and erase them is exercised.
The data subject has the right to free access to the stored data and to request their limitation, rectification, opposition, or erasure when, among other legal grounds, the contact data is inaccurate or no longer necessary for the purpose that justified their collection.
The data subject also has the right to withdraw their consent at any time without compromising the processing's lawfulness based on the previously given consent.
If technically possible, they may request the portability of their data to another controller, in which case they will only be retained for the exercise or defense of claims.
When exercising some of the aforementioned rights, we reserve the right to retain the data solely for the declaration, exercise, or defense of a right in a judicial process.

NU Wines does not transfer collected contact data to third parties. If a legitimate reason for their transfer arises, the customer will be informed in advance, with the identity of the recipients and the purpose of processing the transferred data.
Transfer only occurs when third parties present sufficient guarantees of implementing adequate technical and organizational measures, ensuring that processing complies with applicable data protection legislation and safeguards the data subject's rights.
9. Declaration of Responsibility
NU Wines expressly declares and guarantees that:
a) It will adequately handle the personal data collected from its customers within the scope of the Online Store service; such data will be lawfully and confidentially processed, fairly and transparently, ensuring their security, specifically committing to protect this personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized dissemination or access;
b) It is in a position to ensure all appropriate technical and organizational measures so that the processing of personal data meets the requirements of the current Data Protection Law, approved by Law No. 67/98, of October 26, and by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, ("GDPR"), which will come into effect on May 25, 2018;
c) Personal data is intended solely for executing orders placed in the online store, being only collected, adequate, relevant, and limited to this purpose;
d) It will keep personal data accurate and up-to-date;
f) It will not use the personal data it has access to for any purpose other than that provided for in these Terms and Conditions;
g) At the customer's request, it will immediately and effectively destroy the personal data.
